1. Acceptance of Terms

By accessing and using HytaleServers.it ("the Site"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Site.

2. Registration and Account

Registration is required to add a server or use certain features.

• You are responsible for maintaining the security of your account and password.
• Creating multiple accounts to manipulate votes or spam is prohibited.
• We reserve the right to suspend or delete accounts that violate rules without notice.

3. Server Submission Rules

Server owners guarantee that their service complies with the EULA and Server Policies of Hytale and declare that:

• The server content does not violate applicable laws or third-party rights.
• The server does not contain pornographic, illegal, or hateful material.
• Descriptions and banners are not misleading ("Clickbait").
• Using automated systems (bots) or proxies to fake votes is prohibited.
• Votes detected via VPN, Proxy, or anonymous networks will be automatically cancelled by the system.
• The server DOES NOT use, issue, or promote NFTs, speculative cryptocurrencies, or blockchain-based "play-to-earn" schemes. (No NFT/Crypto)
• The server DOES NOT facilitate gambling or wagering (including in-game casinos) involving items of value or real currency. (No Gambling)
• If the server sells random items (Loot Boxes), it must clearly disclose the odds of winning and prohibit purchase by minors. (Loot Box Transparency)
• The server DOES NOT use logos, trademarks, or names in a way that suggests official affiliation or endorsement by Hypixel Studios. (No Impersonation)
• The server DOES NOT distribute original game files, cracked clients, or software to bypass license protections (No Piracy). (No Piracy)
• The server DOES NOT promote, distribute, or encourage the use of cheats, hacks, or game exploits. (No Cheats)
• The server DOES NOT contain or distribute viruses, malware, spyware, or any other harmful code. (No Malware)
• The server commits to handling player data (e.g., IPs, emails) in compliance with applicable privacy laws (GDPR). (Data Privacy)
• The server DOES NOT block, limit, or charge extra fees for the use of Official Cosmetics (skins, assets) legitimately owned by users on Hytale. (Official Cosmetics)
• The server ensures a safe gaming environment and has adequate moderation measures against harassment and severe abuse. (Safety & Moderation)
• The server DOES NOT allow "Cash-Out" or the trading of virtual items/currency between players for real money (RMT - Real Money Trading). (No RMT/Cash-Out)
• The server guarantees that its content is correctly rated (e.g., age rating) and does not expose minors to inappropriate material without warning. (Content Rating)
• The server owner is solely responsible for the payment of any taxes, fees, or revenue share amounts due to Hypixel Studios. (Fiscal/Revenue Share)
• HytaleServers.it reserves the right to remove any server without appeal if requested by Hypixel Studios or if the server is placed on an official developer "blacklist". (Official Takedown/Blacklist)

4. Paid Services ("Sponsor") and Refunds

HytaleServers.it offers premium visibility services ("Sponsor") via the Stripe payment platform.

A. Nature of Service

The purchase of a Sponsor slot is classified as the supply of digital content via non-tangible media. Service execution begins immediately upon payment (or on the booked date).

B. Refund Policy

In accordance with current regulations on digital products, NO right of withdrawal or refund is provided once the service has been activated, except in cases of prolonged technical failure attributable solely to HytaleServers.it (e.g., site offline for more than 48 hours).

Refunds will not be issued if:

• Your server goes offline or closes during the sponsorship period.
• Your server is banned from the list for violating regulations (e.g., fake votes).
• You change your mind after purchase.

5. User Generated Content

You retain rights to content you upload (logos, descriptions), but grant HytaleServers.it a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute such content in connection with the Site's service.

6. Limitation of Liability

HytaleServers.it is a third-party server list.

• We are not responsible for what happens inside the listed game servers.
• We do not guarantee that the Site will always be available, secure, or error-free.
• We are not liable for any data loss or damages resulting from the use of the Site.

7. Changes to Terms

We reserve the right to modify these terms at any time. Changes are effective immediately upon posting to the Site. Continued use of the Site constitutes acceptance of changes.

9. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute regarding the interpretation or execution of these terms that cannot be resolved amicably, the Court of Brescia (Italy) shall have exclusive jurisdiction, except for mandatory forums provided by law for consumer protection.
